March 5, 2011 | Kenji | 2 Comments Eagle Mountain, CA: On Friday, February 25, the Obama Administration dealt a heavy blow to the proposed Eagle Mountain dump at Eagle Mountain, nestled in the arms of Joshua Tree National Park. After nearly 24 years of defending the dump in court, the Department of Interior reversed its longstanding position and opposed the dump developer’s petition to the U.S. Supreme Court. This substantially weakens the developer’s case and may persuade the Supreme Court to reject the petition, leaving in place lower court rulings that protect the park. This is a fantastic victory for JTNP and the community of Joshua Tree. hmmm… maybe not so fast. The Supreme Court today (March 28) announced today they will not intervene in the dispute between Kaiser and BLM on the deal to trade federal lands to allow Eagle Mtn landfill to go forward. One step forward, two steps back maybe. What are your thoughts?
Hmmmmm. Seems to me that “not so fast” isn’t the correct thought. Since: “developer’s petition to the U.S. Supreme Court. This substantially weakens the developer’s case and may persuade the Supreme Court to reject the petition…” It appears Kenji, in your March 28 2011 statement to wit: “…they will not intervene in the dispute between Kaiser and BLM on the deal to trade federal lands to allow Eagle Mtn landfill to go forward.” From what I read here, it appears the USSup Court refused to hear the petitioner’s argument, making his appeal mute. Sounds like a “win-win” for JTNP BF
